84th Recap: Removal of Tenant's Personal Property Following an Eviction Suit

One of the more unique bills we saw this session was HB 1853, which did pass and waits for the governor's signature or veto. HB 1853 is unique in that it would allow cities to provide a portable container, at no cost to the landlord or tenant, whereby the officer exercising the writ of possession could place the evicted tenant's personal property. The city can later remove the container from the location near the rental unit and dispose of the contents if the evicted tenants fail to return to claim their personal property.

This bill originated from the City of Garland which has such a portable container program. If the governor approves the bill into law it will be interesting to see if other cities choose to avail themselves of this new permissible provision.
