DJ reports: TDHCA MH Division Board Meeting

The board of the Manufactured Housing Division of TDHCA met Feb. 10 at the Texas Capitol to discuss four agenda items. After approving the previous meeting minutes, and a discussion regarding a salesperson application, the board took up their third agenda item. Following the recommendation of the department, the board unanimously voted to re-approve TMHA as a certified continuing education provider. The renewal is good for a two-year extension.

The forth agenda item related to proposed administrative rule changes. The majority of the rule changes related to 2011 legislative changes regarding the initial education requirements for licensure. The proposed rules were previously posted in the Texas Register, and TMHA  submitted brief public comments. A recommendation was made by department staff to make a minor non-substantive correction and withdraw the proposed rule related to requiring a copy of the deed record when applying for an abandoned home statement of ownership and location. The board concurred with staff’s recommendation and approved the proposed rules as amended.

Executive Director, Joe Garcia, then presented his report of current operations to the board. The department continues to perform at high levels across the board. In the previous three months the division issued one warning letter and one consent order. Ten cases where referred to the Attorney General’s office, 14 cases resolved through the Home Owner’s Recover Trust Fund, 24 resolved without a violation and 29 cases were closed as being out of warranty or lack of evidence.

For the current fiscal year consumer complaint resolution time is 107 days. After the November and January initial licensing classes, the MH Division granted 32 retailer, 29 installer and 130 salesperson licenses. 

In the past three months the division handled 21,470 calls and 325 walk-in customers. Also in the past three months the department issued 10,439 new and used SOLs with an average processing time of eight days.

3,838 new HUD Code homes shipped in December 2011 - up 38 percent from December 2010

MHI’s Monthly Economic Report© for December 2011 is now available.

Manufactured home shipments for December 2011 were 3,838 new homes, up 38 percent from December 2010. Increases were across the board with shipments of both single-section and multi-section homes up compared with the same month last year. Single section homes accounted for the largest portion of the increase, with shipments up 54.5 percent compared with December 2010 figures. The increases were, in part, due to the purchase of 1,735 homes (mainly new single section homes) by FEMA, in the last quarter of 2011 (see Note).

Compared with 2010, shipments of new manufactured homes in 2011 declined in each of the first seven months. August marked the first year-over-year monthly gain with the upward trend continuing through the end of the year. Industry shipments for the year-to-date stand at 51,606 homes compared with 50,046 homes in the previous year, a net increase of 3.1 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 55,478 in December, down 18.9 percent from the rate of 68,389 in November 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in December 2011 were 5,885, an increase of 33.6 percent over December 2010. The number of plants reporting production in December was 122, down three from last month. The number of manufacturing companies was 45, unchanged from the prior month.

Note: Shipment and production figures were impacted by the purchase of approximately 1,735 manufactured homes by the Federal Emergency Management Agency (FEMA). The FEMA homes were built and shipped in October, November and December of 2011. While a breakdown of FEMA homes by state and month is not available, these homes are included in the production and shipment figures provided in this report. States that serve as staging areas for warehousing homes or that received new homes in response to natural disasters, have the FEMA homes included in their monthly and annual shipment figures. In particular, in November a significant number of FEMA homes were shipped to Maryland, Alabama and North Dakota.

Request for industry input: weatherization & energy retrofit specifications

Our industry has been invited by the Department of Energy (DOE) and the National Renewable Energy Laboratory (NREL) to comment on the Manufactured Housing Standard Work Specifications.

Developed under the Guidelines for Home Energy Professionals project - a collaboration between DOE and industry to support high-quality home energy upgrade work - these specifications serve as voluntary guidelines that set a foundation for high-quality installation of energy efficiency measures in single-family homes, multifamily homes, and manufactured housing.  

These new guidelines will be useful primarily to the retrofit market, but also for new installations that occur outside the factory. While several industry representatives have provided assistance during the development of these guidelines, the DOE is seeking additional comments on the latest specifications.

If you perform retrofit work, please feel free to review and comment on these national specifications before next Friday, Feb. 3.

5,301 new HUD Code homes shipped in November 2011 - up 53.1 percent from November 2010

MHI’s Monthly Economic Report© for November 2011 is now available.

Manufactured home shipments for November 2011 were 5,301 new homes, up 53.1 percent from November 2010. Increases were across the board with shipments of both single-section and multi-section homes up compared with the same month last year. Single sections accounted for the bulk of the increase, with shipments up 114.6 percent over the figures for last November. These increases were, in part, due to the purchase of 1,735 homes (mainly new single section homes) by FEMA, in the last quarter of 2011 (see Note).

Compared with 2010, shipments of new manufactured homes declined in each of the first seven months. August marked the first year-over-year monthly gain with the upward trend continuing through the current month. Industry shipments for the year-to-date stand at 47,768 homes compared with 47,265 homes in the previous year, a net increase of 1.1 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 68,389 in November, up 18.9 percent from the rate of 57,523 in October 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in November 2011 were 7,485, up 35.7 percent from the same month in 2010. The number of plants reporting production in November was 125, up two from the number in October, and the number of corporations was 45, unchanged from the prior month.

TMHA Alert - Abandoned homes: the proper process

It has recently come to my attention some TMHA members who proceed through the statutory provisions for declaring a home abandoned could be dangerously confused regarding the proper process. This alert applies mostly to communities that occasionally declare homes in their communities abandoned.

THE DANGER

Community owners declaring abandoned homes with initial titles under a home inventory company vs. in the name of the person/entity who owns the real property where the home is located (meaning the name on the real property deed records). 

I realize companies often have multiple entities. Many have each community location structured in a single entity. Some similarly have another legal entity where various inventories of homes are titled and held. However, we must ensure our members go about this process the right way.

THE ISSUE

  1. A home is declared abandoned, applicable affidavit signed and sent to TDHCA's MH Division, BUT
  2. the entity declaring the home abandoned and asking for a new title is NOT the same entity that owns the real property where the home is physically present.

THE SOLUTION

You must first apply for abandoned home titles under the entity that owns the real property on which the home is physically present.

After the initial abandoned home title is issued, if the desire to move the ownership of the home into another entity typically used for holding ownership of home inventory remains, another SOL Application is required. This step will move the home from the real property, community entity into the inventory-holding entity.

ADDITIONAL POINTS FROM DJ

I realize some might object to an additional step and another $55 SOL Application fee. However, I cannot stress enough how critical it is to conduct your abandoned home processes this way.

The law is crystal clear in Texas Occupations Code 1201.217. Only the owner of the real property where the home is located is eligible to declare a home abandoned. The law does not have any common ownership or affiliated subsidiary company allowance to title the home to any other entity.

Additionally and most importantly, to declare a home abandoned one must complete the TDHCA form - Affidavit of Fact for Abandonment. This affidavit is a sworn and notarized statement of the person/entity who owns the real property declaring the home abandoned. If, in the scenario I laid out above, the person/entity who submits this affidavit is in fact NOT the actual owner of record of the real property (i.e. the inventory holding entity), then the person has committed fraud. Fraud is not only actionable as a department enforcement action, but can carry severe criminal liability.*

I strongly encourage all TMHA members who have declared homes abandoned to examine your process and records. Certain steps can be taken in light of an inadvertent mistake to immediately correct such missteps.

Again, now is the time to make a correction. Do not delay. I earnestly stress all members possibly impacted by this new information not risk “flying under the radar.” I assure you proactive, immediate, corrective action will be far less costly and will protect you and your business in the long run.


*Fraud based on the amount of the fair market value of the property between $1,500 - $20,000 is a state jail felony. Fraud between $20,000 - $100,000 is a third degree felony, and over $100,000 is a second degree felony. Texas Penal Code states: “When amounts are obtained in violation of this chapter pursuant to one scheme or continuing course of conduct, whether from the same or several sources, the conduct may be considered as one offense and the amounts aggregated in determining the grade of offense.” Therefore, for those who might have inadvertently made multiple mistakes, an argument can be made to aggregate all offenses and all values of the homes to arrive at the level of punishment.

Sec. 12.32. FIRST DEGREE FELONY PUNISHMENT. (a)  An individual adjudged guilty of a felony of the first degree shall be punished by imprisonment in the Texas Department of Criminal Justice for life or for any term of not more than 99 years or less than 5 years.
(b) In addition to imprisonment, an individual adjudged guilty of a felony of the first degree may be punished by a fine not to exceed $10,000.
Sec. 12.33.  SECOND DEGREE FELONY PUNISHMENT. (a) An individual adjudged guilty of a felony of the second degree shall be punished by imprisonment in the Texas Department of Criminal Justice for any term of not more than 20 years or less than 2 years.
(b) In addition to imprisonment, an individual adjudged guilty of a felony of the second degree may be punished by a fine not to exceed $10,000.

5,436 New HUD Code Homes Shipped in October 2011 – up 41.5 Percent from October 2010

MHI’s Monthly Economic Report© for October 2011 is now available.

Manufactured home shipments for October 2011 were 5,436 new homes, up 41.5 percent from October 2010. Increases were across the board with shipments of both single-section and multisection homes up compared with the same month last year. Single sections accounted for the bulk of the increase, with shipments up 92 percent over the figures for last October.

Compared with 2010, this year the industry experienced declines in each of the first seven months. August marked the first year-over-year monthly gain with the upward trend continuing into the months of September and October. Industry shipments for the year-to-date stand at 42,467 homes compared with 43,802 homes in the previous year, a net decrease of 3 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 57,523 in October, up 5 percent from the rate of 54,790 in September 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in October 2011 were 7,885, up 27 percent from the same month in 2010. The number of plants reporting production in October was 123 and the number of corporations was 45, both unchanged from the prior month.

The Texas Department of Housing and Community Affairs has issued the following announcement:

"Complaints regarding the business activity of Jo Leigh Ares, doing business as The Park Girl, 1000 E. Exp 83, La Feria, TX 78559, have been circulated in the media and reported to the Division.

Any Texas consumer with a complaint regarding this manufactured housing retailer should contact the Consumer Complaints Hotline at: (877) 313-3023 for immediate assistance.

A consumer complaint form (DOC) should be completed and mailed to the Division along with all evidence of activity such as bill of sale, purchase contracts, proof of purchase, receipts for deposits, refund checks that were stopped, or any other documentation proving that the consumer is due money, a home, or statement of ownership and location (formerly known as a title).

Resolving a complaint involves documentation, investigation, and resolution, which may take up to 180 days (or more in extreme cases) if the case is appealed, contested, or taken to hearing."

NMHC Quarterly Modular Housing Report

NMHC's Quarterly Modular Housing Report© for the 3rd Quarter of 2011 is Now Available

The National Modular Housing Council’s actual shipments report indicates that 3,544 new modular homes were shipped in the third quarter of 2011, down 2.0 percent from the same quarter in 2010.

Relative to Q3 2010, state shipment results for the third quarter 2011 showed increases for six states, reductions in 18 states and five states with no significant change (defined as less than or equal to ±5 shipments).

MHI’s Monthly Economic Report© for September 2011 is now available.

Manufactured home shipments for September 2011 were 5,037 new homes, up 13.4 percent from September 2010. Trends varied by housing type with shipments of multi-section homes down compared with the same month last year, while shipments of single section homes showed a 32.5 percent increase.

Compared with 2010, this year the industry experienced declines in each of the first seven months. August marks the first year-over-year monthly gain with the upward trend continuing in the month of September. Industry shipments for the year-to-date stand at 37,031 homes compared with 39,961 homes in the previous year, a net decrease of 7.3 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 54,790 in September, up 1.4 percent from the rate of 54,026 in August 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in September 2011 were 7,582, up 8 percent from the same month in 2010. The number of plants reporting production in September was 123 and the number of corporations was 45, both unchanged from the prior month.

Lt. Gov. David Dewhurst issued interim charges asking Senators to look at a variety of issues raised by this summer's drought and wildfires. The Intergovernmental Relations Senate Committee is met Nov. 2 for a hearing on the charges.
 
TMHA Executive Director DJ Pendleton sat on a panel and testified on behalf of the state's manufactured and modular housing industry and the role we can play in disaster recovery.

Bringing it All Home: USDA Programs for Manufactured Homes and Communities Webinar

Please join us for a dialogue about the importance of core USDA Rural Development grant and loan programs. Hear about the creative ways in which I’M HOME partners, working with their regional partners at USDA RD offices, have used these programs to promote manufactured housing as an affordable housing option in rural communities.

With more than 17 million Americans living in manufactured housing, these homes make up the largest source of affordable housing in the nation. Some of these families live in manufactured home communities and others’ homes are on private land. These two situations – along with many other nuances of manufactured housing – create unique opportunities and challenges for the use of federal grant and loan programs like those offered by USDA.

 The webinar will be moderated by Rick Haughey, CFED’s Director of Affordable Housing Initiatives, and panelists include: a national USDA representative, a nonprofit national distributor of high-quality manufactured homes, a community loan fund that helps manufactured home community residents organize to cooperatively purchase their communities and their USDA RD partners from their state offices.

MHI’s Monthly Economic Report© for August 2011 is now available.

Manufactured home shipments for August 2011 were 5,166 new homes, up 6.3 percent from August 2010. Trends by housing type varied with shipments of multi-section homes down compared with the same month last year, while shipments of the single section homes showed a 21.7 percent increase.

Compared with 2010, this year has seen declines in each of the first seven months, with the first year-over-year gain in the month of August. Industry shipments for the year-to-date stand at 31,994 homes compared with 35,521 homes in the previous year, a net decrease of 9.9 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 54,026 in August, up 22 percent from the rate of 44,285 in July 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in August 2011 were 7,913, up 1.8 percent from the same month in 2010.

The number of plants reporting production in August was 123 and the number of corporations was 45, both unchanged from the prior month.

MHI July 2011 Monthly Economic Report

3,679 new HUD Code homes shipped in July 2011 - down 13.6 percent from July 2010

MHI’s Monthly Economic Report© for July 2011 is now available.

Manufactured home shipments for July 2011 were 3,679 new homes, down 13.6 percent from July 2010. Decreases were across the board with both single-section and multi-section homes shipments down compared with the same month last year.

Compared with 2010, this year has seen declines in all of the seven months so far. Industry shipments for the year-to-date stand at 26,828 homes compared with 30,659 homes in the previous year, a net decrease of 12.5 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 44,285 in July, down 16.8 percent from the rate of 53,233 in June 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total. Total floors shipped in July 2011 were 5,789, down 15.2 percent from the same month in 2010.

The number of plants reporting production in July was 123 and the number of corporations was 45, both unchanged from the prior month.

New laws in effect September 1, 2011

Laws passed during 2011 Session now effective

The effective date for all legislation passed during the 2011 Texas Legislative Session is September 1, 2011.

Changes for manufactured housing
This session, TMHA aided the successful passage of HB 1510, a clean-up bill for the Texas statue governing manufactured housing (a.k.a Chapter 1201 of the Texas Occupations Code). Please note the code will not reflect the 2011 changes until 2012.

Texas S.A.F.E. Act changes
The S.A.F.E. Act de minimus, allowing five owner-financed home sales within a 12 month period without a MLO license also passed this session.

Please note the change to the Pre-Construction Conference Guide, form - Exhibit 14, Appointment of Labor Standards Officer.

"An Owner or Owner/Developer must appoint an objective Labor Standards Officer, one not employed by any construction company or affiliate whose work they will monitor."

This does not constitute a change in policy but merely a reiteration of existing policy in hopes of preventing future findings for contract administrators.

NMHC Quarterly Modular Housing Report

NMHC's Quarterly Modular Housing Report© for the 2nd Quarter of 2011 is Now Available

The National Modular Housing Council’s actual shipments report indicates that 3,339 new modular homes were shipped in the second quarter of 2011, down 14.8 percent from the same quarter in 2010.

Relative to Q2 2010, state shipment results for the second quarter 2011 showed increases for five states, reductions in 19 states and five states with no significant change (defined as less than or equal to ±5 shipments).

TMHA testifies at TDLR IHB meeting

At last Wednesday's IHB TDLR Council Meeting, I testified before the Council on a wide range of modular housing issues. Prior to the meeting TMHA worked closely with several industry participants as well as numerous discussions at recent TMHA Board meetings. TMHA compiled these issues into a single document, which I presented to the Council.

In my testimony I spoke about specific concerns and cited several illustrative incidences. I am pleased to report the Council was receptive to all our concerns and we are now collectively working to make improvements.

Specifically, the Council agreed it is not the responsibility of the Council nor TDLR to establish or enforce warranty related issues between a modular builder and their consumer. They agree with TMHA these issues should be resolved based on the contractual arrangement between builder and consumer.

Additionally, TDLR Executive Director Bill Kuntz established clarity on the issue of timely consumer complaints. Many TMHA members brought consumer complaints related to homes several years old to my attention; in some cases homes, had been bought and sold several times since original construction. Previous to Wednesday's meeting, the IHB Division issued violations to builders related to these homes. When I brought this issue to the attention of the Council Mr. Kuntz informed the Council TDLR is limited within their authority to only address issues brought within two years of the incident. While we will continue to work on further specifics, generally as a result of the meeting all consumer complaints after two years of final construction, installation and inspection are not timely. There is a provision that would allow a complaint beyond two years, but to invoke this provision permission must be given directly by Mr. Kuntz after he is shown good cause/reason why the complaint was not timely.

In addition to the answers on timely complaints, TDLR will respond in writing to all of the issues I brought to their attention. You can read TMHA's presentation here.

The Council was also made aware of the current issues related to coastal homes and the disconnect between TDLR and the Texas Department of Insurance. This issue has also been given specific attention, and we are working to provide a solution.

These efforts will be an ongoing process over the next several months. TDLR will respond to our issues, and we will provide public comment to recently published proposed rules. All of these efforts will then be reexamined at the next Council meeting at the end of October.

I'd like to extend my personal thanks for all of the help and support I received from those industry persons involved with this effort. We must continue to work together in the coming months, and TMHA looks forward to providing a better regulatory environment in Texas for the modular home industry.

5,024 New HUD Code Homes Shipped in June 2011 - Down 7.5 Percent from June 2010

MHI’s Monthly Economic Report© for June 2011 is now available.

Manufactured home shipments for June 2011 were 5,024 new homes, down 7.5 percent from June 2010. Trends by housing type were mixed with multi-section homes shipments down compared with the same month last year, while the single section homes shipments showed an increase.

In comparison with the first half of 2010, 2011 has seen declines in all of the six months. Industry shipments for the year-to-date stand at 23,149 homes compared with 26,402 homes in the previous year, a net decrease of 12.3 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 53,233 in June, up 7.8 percent from the rate of 49,397 in May 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total. Total floors shipped in June 2011 were 7,866, down 10.5 percent from the same month in 2010.

The number of plants reporting production in June was 123 and the number of corporations was 45, both unchanged from the prior month.

TDHCA Compliance, Real Estate Analysis Roundtable

The Texas Department of Housing and Community Affairs will host a roundtable discussion on Monday August 1, 2011 to solicit input on Department Rules.

Beginning at 9 a.m. the discussion will focus on the Compliance Rules including subchapter A of the Compliance Monitoring Rules. In addition, Department staff would like input on the concept of  a new rule regarding income and rent limits.

At 1 p.m. the discussion will continue focusing on the Real Estate Analysis Rules.

Homebuyer Assistance Program training August 31 in Austin

The Texas Department of Housing and Community Affairs' HOME Program invites you to attend a one-day training for the Homebuyer Assistance (HBA) Program. The Homebuyer Assistance Program provides funding to assist eligible low-income homebuyers with down payment and closing cost assistance. Funds may also be provided for required accessibility modifications.  

The training will be held in Austin, Texas on Wednesday, August 31, 2011 in Room 2.122 of the Thompson Conference Center at the University of Texas campus, located at 2405 Robert Dedman Drive, Austin, TX 78713, from 8 a.m. until 4:30 p.m. Case studies will be reviewed so attendees are encouraged to bring their laptops; internet access will be provided.

Income limits, revised HOME Program limits & Project Income and Rent Tool

TDHCA has posted the 2011 Income and Rent Limits for the Housing Tax Credit, Tax Exempt Bond, HOME, Neighborhood Stabilization and Housing Trust Fund rental programs. The Housing Tax Credit, Tax Exempt Bond, Neighborhood Stabilization and Housing Trust Fund limits are effective as of May 31, 2011.

The HOME program income and rent limits are effective as of July 13, 2011. Please note that the HOME program income and rent limits released by HUD on June 13, 2011 contained errors. HUD released revised HOME program limits late in the day on July 12. If you accessed the HOME program income and rent limits prior to this email, please re-check.

Note that the "Final 2011 HTC Income and Rent Limits by Property" listing shows the income and rent limits for the Housing Tax Credit program only. If your Housing Tax Credit property is layered with another Department program, you will need to use the Project Income and Rent Tool to obtain the income and rent limits for the other program and use the most restrictive as applicable.

4,475 New HUD Code Homes Shipped in May 2011 - Down 10.9 Percent from May 2010

MHI’s Monthly Economic Report© for May 2011 is now available.

The Manufactured Housing Institute’s shipments report indicates that 4,475 new HUD-code homes were shipped in May 2011, down 10.9 percent from May 2010. Trends by housing type diverged significantly with multi-section home shipments down 23.8 percent compared with the same month last year, while the single section home shipments showed a 9.6 percent increase.

Compared to same month date for 2010, 2011 has seen declines in each of the first five months. Industry shipments for the year-to-date stand at 18,125 homes compared with 20,972 homes in the previous year, a net decrease of 13.6 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 49,397 in May, up 9.7 percent from the rate of 45,028 in April 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in May 2011 were 6,872, down 16.2 percent from the same month in 2010.

The number of plants reporting production in May was 123, one less than the figure for April, and the number of corporations was 45, unchanged from the prior month.

Personnel changes at HUD

Today HUD announced that Teresa Payne, Associate Deputy Assistant Secretary for Regulatory Affairs and Manufactured Housing will leave her post effective July 31 and join the new Consumer Financial Protection Bureau. 

Effective July 17, Elizabeth Cocke, the Deputy Administrator of the Manufactured Housing program at HUD will move to HUD’s Office of Policy Development and Research where she will serve as the Director of Affordable Housing, Research and Technology Division.  
 
Henry Czauski has been named to replace Liz as the Acting Deputy Administrator for the Office of Manufactured Housing. Henry, who has been working with Liz and Teresa for the last year, has served in HUD’s Office of General Counsel for a number of  years in a variety of positions.  He most recently served as the Deputy Director of HUD’s Departmental Enforcement Center.

The seasonally adjusted annual rate (SAAR) of shipments was 45,028 in April, down 11.6 percent from the rate of 50,920 in March 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.
Total floors shipped in April 2011 were 6,138, down 21.7 percent from the same month in 2010. The number of plants reporting production in April was 124, and the number of corporations was 45, both the same as reported in March.

TDHCA creates new e-mail list

Beginning June 1, 2011, the Housing and Health Services Coordination Council will be providing an email list. The purpose of this Council, as written in the statute, is to increase state efforts to offer service-enriched housing through increased coordination of housing and health services.

In order to assist local organizations interested in participating in service-enriched housing, the Council has launched this list, which will identify and disseminate information regarding sources of funding from a variety of state and federal government agencies that may be used to provide integrated housing and health services. Notices of these funding opportunities or changes in existing funding programs will be disseminated on a monthly basis.

The intended audience for these announcements is local organizations interested in participating in service-enriched housing, whether through the development of affordable housing or the provision of services and supports. These can be nonprofit organizations, local governments, regional consortia, developers, service providers, etc.

Compared with 2010, this year has started off with declines in the first three months. Industry shipments for the year-to-date stand at 9,696 homes compared with 11,132 homes in the previous year, a net decrease of 12.9 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 50,920 in March, up 19.6 percent from the rate of 42,586 in February 2011. The SAAR corrects for normal seasonal variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in March 2011 were 6,232, down 13.2 percent from the same month in 2010. The number of plants reporting production in February was 124, and the number of corporations was 45, both down by four compared with the prior month.

TDHCA: Governing Board meets May 5

The Texas Department of Housing and Community Affairs Governing Board will meet on May 5, 2011, beginning at 9 a.m., in the Ric Williamson Hearing Room of the Dewitt C. Greer Building (TxDOT building), located at 125 E. 11th St., Austin, Texas.

The Department is pleased to announce that the Chief Justice of the Supreme Court of Texas, The Honorable Wallace Jefferson, will administer an oath of office to new board member J. Paul Oxer at 9 a.m.   

The Department also advises the public that TDHCA Executive Director Michael Gerber has indicated his intention to step down from his position in June. The TDHCA Governing Board invites the public to recognize and celebrate Mr. Gerber's service at the next board meeting on Thursday, June 30th.

Governor reappoints six to Industrialized Building Code Council

Gov. Rick Perry has appointed six members to the Texas Industrialized Building Code Council for terms to expire Feb. 1, 2013. The council oversees the inspection of industrialized housing and buildings to ensure state standards are enforced.

Governor appoints Burks to Manufactured Housing Board

AUSTIN – Gov. Rick Perry has appointed Anthony Burks of Fort Worth to the Manufactured Housing Board for a term to expire Jan. 31, 2017. The board regulates the state’s manufactured housing industry.

2,885 New HUD Code Homes Shipped in February 2011 - Down 16.5 Percent from February 2010

MHI’s Monthly Economic Report© for February 2011 is now available.

The Manufactured Housing Institute’s shipments report indicates that 2,885 new HUD-code homes were shipped in February 2011, down 16.5 percent from February 2010. Decreases were across the board with both single-section and multi-section homes shipments down compared with the same month last year. Compared with 2010, this year has started off with a decline in January and February. Industry shipments for the first two months of the year stand at 5,661 homes compared with 6,615 homes in the previous year, a net decrease of 14.4 percent.

The seasonally adjusted annual rate (SAAR) of shipments was 42,586 in February, up 5.1
percent from the rate of 40,521 in January, 2011. The SAAR corrects for normal seasonal
variations in shipments and projects annual shipments based on the current monthly total.

Total floors shipped in February 2011 were 4,525, down 19.4 percent from the same month in 2010. The number of plants reporting production in February was 128, and the number of corporations was 49, both down, by three and two respectively, from the prior month.

Urge Congress to Preserve Affordable Manufactured Housing by Reducing Regulatory Burdens on Manufactured Homeowners

BACKGROUND:
The Dodd-Frank Wall Street Reform and Consumer Protection Act (P.L. 111-203) is the most sweeping rewrite of rules governing banking and financial services in decades. The Act adds significant new requirements on residential mortgages, including limitations on origination activities, high-cost mortgages and appraisals. Administration officials are already in the process of drafting regulatory changes required by the Act.

ISSUE OVERVIEW: Unless Congress passes legislation reducing burdens the Act places on low- and moderate-income manufactured homeowners, credit available for manufactured housing could be cut in half. GRASSROOTS ACTION NEEDED: MHI members and all industry stakeholders must contact their U.S. Senators and U.S. Representatives and urge they support legislation that offsets Dodd-Frank’s unintended consequences of constraining lending activities within the manufactured housing market, particularly among low- to moderate-income homebuyers, specifically:

1) MHI members, including state executives, manufacturers, suppliers, community owners and lenders, are asked to personally contact their Senators and Representatives and ask them to champion legislation to help low- to moderate-income families seeking affordable financing for manufactured housing.

b. Personally contact your Member of Congress or staff responsible for housing issues and explain the impact provisions within Dodd-Frank will have on the availability manufactured home financing.

c. MHI has developed sample legislation that proposes several remedies to the Dodd-Frank Act to ensure that affordable manufactured housing financing remains available. If your Member of Congress is interested in introducing legislation, please have them follow up directly with MHI staff (Jason Boehlert at 703.558.0660 or jboehlert@mfghome.org).

2) If you have a Member of Congress in your delegation that serves on either the House Financial Services Committee or Senate Banking Committee, please personally contact their offices as soon as possible (in addition to sending the letter mentioned above) - click here for the membership rosters for the committees, with staff contact information and urge they:

a. Help champion and/or introduce legislation that ensures low- and moderate-income manufactured homeowners will continue to have access to financing to buy, sell or refinance manufactured homes.

b. Contact the Chairman and/or Ranking Member of the Senate Banking or House Financial Services Committees and specifically request provisions that address the specific financing needs of manufactured homeowners be included in any Dodd-Frank corrections bill.

3) If you are a manufactured home community owner, please urge community residents to also contact their Members of Congress. Samples are provided here:

Justification for Administrative Rule Adoption

At their meeting held March 4, 2011, the Texas Commission of Licensing and Regulation adopted amendments to existing rules at 16 Texas Administrative Code, Chapter 75, §§75.10, 75.20-75.28, 75.30, 75.40, 75.65, 75.70, 75.71, 75.73, 75.80, 75.90, and 75.100 and new rules at §§75.29, 75.91, and 75.110 regarding the air conditioning and refrigeration program.
 
The adopted amendments and new rules reflect the public comments submitted in response to the Notice of Intent to Review published in the September 11, 2009, issue of the Texas Register (34 TexReg 6350), the Department’s own review of the rules, and input and recommendations from the Air Conditioning and Refrigeration Contractors Advisory Board on the rule review proposal and the rule simplification initiative.  The adopted amendments and new rules also reflect public comments received during the 30-day public comment period and during the January 13, 2011, public hearing on the proposed amendments and new rules; recommendations from the Advisory Board at its February 22, 2011, meeting; and Department staff technical changes.
 
The adoption is published in the March 25, 2011, issue of the Texas Register (36 TexReg 1975).  The adoption takes effect April 1, 2011.
 
TDLR encourages all persons interested in the air conditioning and refrigeration program to review the rule adoption.

TDHCA: Davis-Bacon Labor Standards Officer

To prevent and ensure compliance with conflict of interest requirements, Davis-Bacon Labor Standards Officers (LSO) must receive their pay and authority directly from project owners, not any entity immediately responsible for hiring construction workers.

The U.S. Housing and Urban Development (HUD) - Office of Labor Relations and the Texas Department of Housing and Community Affairs has revised compliance requirements concerning the selection and appointment of the Labor Standards Officer (LSO) for recipients of federal funds that are subject to the Davis-Bacon and Related Acts, as requested by HUD to provide further clarity and separation of duties. An Owner or Owner/Developer can no longer appoint an employee whose salary is paid for by the affiliate construction company or third party company involved with the project's construction. This compliance requirement becomes effective immediately.

Furthermore, the LSO must obtain the worker's signature on the "Consent to Voluntarily Disclose Confidential Wage-Earner Information" (Pre-Construction Guide Exhibit 8b http://www.tdhca.state.tx.us/program-services/docs/ConsentDisclose.pdf) when conducting a worker interview on the construction job-site. The form notifies the worker that the Owner or Owner/Developer hired the LSO, and assures the worker that any information disclosed during the interview is confidential and reported violations of federal labor laws will be investigated in accordance with labor law mandates. The Davis-Bacon and Federal Labor Laws Preconstruction Conference form has been updated to include the new requirements.  These forms are available on the Program Services - Davis Bacon website http://www.tdhca.state.tx.us/program-services/davis-bacon.htm.

This guidance pertains ONLY to HUD Community Planning and Development (CPD) program activities; this does not pertain to weatherization programs.

Governor reappoints Bray to Manufactured Housing Board

Governor Rick Perry has reappointed Michael Bray of El Paso to the Manufactured Housing Board for a term to expire Jan. 31, 2017. The board regulates the state's manufactured housing industry.

Bray is a Realtor with Prudential BKB Realtors. He is director of the National Association of Realtors and Frontera Land Alliance, and a member of the Texas Association of Local Housing Finance Agencies and El Paso Medical Facilities Development Corporation. He is president of the El Paso Property Finance Authority, vice president of the El Paso Housing Finance Corporation and an alternate member of the City of El Paso Zoning Board of Adjustments. He is also past chair of the City of El Paso Building and Standard Committee, past regional vice president of the Texas Association of Realtors, and past vice president of El Paso Habitat for Humanity.

Bray received a bachelor's degree from the University of Texas at El Paso. He will continue to serve as presiding officer of the board for a term to expire at the pleasure of the governor.

This appointment is subject to Senate confirmation.

NMHC’s Modular Housing Report

NMHC's Quarterly Modular Housing Report© for the 4th Quarter of 2010 is Now Available
The National Modular Housing Council’s actual shipments report indicates that 2,789 new modular homes were shipped in the fourth quarter of 2010, down 23.1 percent from the same quarter in 2009.

When compared with the same period last year, state shipment results for the fourth quarter 2010 showed increases for five states, reductions in 22 states and two states with no significant change (defined as less than ±5 shipments).
